Details

Disability law in Korea is still developing, and individuals with disabilities remain among the most marginalized in the financial sector, particularly in insurance contracts. This study compares how the U.S. and Korea address discrimination in this area through laws and judicial precedents, including the Americans with Disabilities Act (ADA) and Korea's Anti-Discrimination Against Persons with Disabilities Act. While the ADA prohibits access-based discrimination, Korean law also bans content-based discrimination.

Despite legal safeguards, discriminatory practices persist in both countries. This research highlights key solutions:
• improving regulatory oversight
• introducing punitive damages
• strengthening court interventions
• promoting socially responsible practices in the financial industry.
